8) Data processing for order processing

8.1 - Transmission of image files for order processing via upload function
On our website, we offer customers the opportunity to personalize products by submitting image files through an upload function for order processing. The submitted image serves as a template for personalizing the selected product.
Using the upload form on the website, the customer can immediately transmit one or more image files from the storage of the used end device to us via automated, encrypted data transmission. We then capture, store, and use the transmitted files exclusively for the production of the personalized product in accordance with the respective performance description on our website. If the transmitted image files are forwarded to special service providers for the production and processing of the order, you will be explicitly informed about this in the following paragraphs. No further forwarding takes place. If the transmitted files or digital images contain personal data (especially images of identifiable persons), all of the aforementioned processing operations are carried out exclusively for the purpose of processing your online order in accordance with Art. 6 para. 1 lit. b GDPR. After the order has been completed, the transmitted image files are automatically and completely deleted.

8.2 To the extent necessary for the processing of contracts for delivery and payment purposes, the personal data collected by us will be transferred to the commissioned transport company and the commissioned credit institution in accordance with Art. 6 para. 1 lit. b GDPR.

If, on the basis of a corresponding contract, we owe you updates for goods with digital elements or for digital products, we process the contact data (name, address, email address) transmitted by you when ordering in order to inform you personally on an appropriate communication channel (e.g. postal or email) about upcoming updates within the legally prescribed period, in accordance with our legal obligation under Art. 6 para. 1 lit. c GDPR. Your contact data will be used strictly for the purpose of notifying you of updates owed by us and will only be processed by us to the extent necessary for this purpose.

In addition, we work with the following service provider(s) to process your order, who support us in whole or in part in the performance of concluded contracts. Certain personal data will be transferred to these service providers in accordance with the following information.

8.3 Use of payment service providers

- Apple Pay
If you choose the payment method "Apple Pay" from Apple Distribution International (Apple), Hollyhill Industrial Estate, Hollyhill, Cork, Ireland, the payment processing will be carried out via the "Apple Pay" function of your iOS, watchOS or macOS device by charging a payment card stored with "Apple Pay". Apple Pay uses security features integrated into the hardware and software of your device to protect your transactions. To authorize a payment, you must enter a code previously set by you and verify it using the "Face ID" or "Touch ID" function of your device.
For the purpose of payment processing, your information provided during the ordering process will be transmitted to Apple in encrypted form along with information about your order. Apple then encrypts this data again with a developer-specific key before transmitting the data to the payment service provider of the payment card stored in Apple Pay. The encryption ensures that only the website on which the purchase was made can access the payment data. After the payment has been made, Apple sends your device account number and a transaction-specific dynamic security code to the originating website to confirm the payment success.
If personal data is processed in the described transmissions, the processing is carried out exclusively for the purpose of payment processing in accordance with Art. 6 para. 1 lit. b GDPR.
Apple stores anonymized transaction data, including the approximate purchase amount, the approximate date and time, and whether the transaction was successfully completed. Anonymization completely excludes any personal reference. Apple uses the anonymized data to improve "Apple Pay" and other Apple products and services.
If you use Apple Pay on your iPhone or Apple Watch to complete a purchase made through Safari on your Mac, the Mac and authorization device communicate through an encrypted channel to Apple's servers. Apple does not process or store any of this information in a format that can identify you personally. You can disable the option to use Apple Pay on your Mac in the settings of your iPhone. Go to "Wallet & Apple Pay" and disable "Allow payments on Mac".
Further information on data protection with Apple Pay can be found at the following web address: https://support.apple.com/de-de/HT203027
Google Pay
If you choose to use the payment method "Google Pay" provided by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"), payment processing will be carried out via the "Google Pay" application on your mobile device with at least Android 4.4 ("KitKat") and NFC functionality, by charging a payment card stored in Google Pay or a verified payment system (e.g. PayPal). For authorizing a payment via Google Pay in an amount of more than 25,- EUR, the prior unlocking of your mobile device is required by the respective verification method (such as facial recognition, password, fingerprint, or pattern).
For the purpose of payment processing, the information provided by you during the ordering process, including information about your order, will be forwarded to Google. Google then transmits your payment information stored in Google Pay in the form of a unique transaction number to the originating website to verify a completed payment. This transaction number does not contain any information about the actual payment data of your payment methods stored in Google Pay, but is created and transmitted as a unique valid numerical token. For all transactions via Google Pay, Google acts only as an intermediary for processing the payment. The transaction is carried out exclusively between the user and the originating website by debiting the payment method stored in Google Pay.
If personal data is processed in the context of the aforementioned transfers, the processing is carried out exclusively for the purpose of payment processing in accordance with Art. 6 para. 1 lit. b GDPR. Google reserves the right to collect, store and evaluate certain transaction-specific information for each transaction made via Google Pay. This includes the date, time and amount of the transaction, merchant location and description, a description of the goods or services purchased provided by the merchant, photos that you have attached to the transaction, the name and email address of the seller and buyer or sender and recipient, the payment method used, your description for the reason for the transaction and, where applicable, the offer associated with the transaction.
According to Google, this processing is carried out exclusively in accordance with Art. 6 para. 1 lit. f GDPR based on the legitimate interest in proper accounting, verification of transaction data, and optimization and maintenance of the Google Pay service.
Google also reserves the right to merge the processed transaction data with further information collected and stored by Google when using other Google services.

10) Online Marketing

10.1 Facebook Pixel for creating custom audiences with advanced data matching (with cookie consent tool)
Within our online offer, the so-called "Facebook Pixel" of the social network Facebook is used in the mode of advanced data matching, which is operated by Meta Platforms Ireland Limited, 4 Grand Canal Quare, Dublin 2, Ireland ("Facebook").
Based on its explicit consent, when a user clicks on an advertisement placed by us on Facebook, the URL of our linked page is supplemented by Facebook Pixel. Then, this URL parameter is written into the user's browser via cookie after redirection, which our linked page sets itself. In addition, specific customer data, such as the email address we collect on our webpage linked to the Facebook ad during transactions such as purchases, account registrations or registrations, are collected by this cookie (advanced data matching). Facebook Pixel then reads this cookie and enables the data, including specific customer data, to be forwarded to Facebook.
With the help of Facebook Pixel with advanced data matching, Facebook can, on the one hand, precisely determine the visitors of our online offer as a target group for displaying ads (so-called "Facebook Ads"). Accordingly, we use Facebook Pixel with advanced data matching to only show the Facebook ads we placed to Facebook users who have shown an interest in our online offer or who have certain characteristics (e.g. interests in certain topics or products, which are determined based on the visited websites) that we transmit to Facebook (so-called "Custom Audiences"). With the help of Facebook Pixel with advanced data matching, we also want to ensure that our Facebook ads correspond to the potential interests of the users and do not appear to be annoying. This way, we can further evaluate the effectiveness of Facebook ads for statistical and market research purposes by tracking whether users were redirected to our website after clicking on a Facebook ad (so-called "Conversion"). Compared to the standard version of Facebook Pixel, the advanced data matching feature helps us to better measure the effectiveness of our advertising campaigns by capturing more attributed conversions.
All transmitted data is stored and processed by Facebook, so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook data usage policy (https://www.facebook.com/about/privacy/). The data can enable Facebook and its partners to display ads on and off Facebook.
These processing operations are carried out exclusively with the express consent in accordance with Art. 6 Para. 1 lit. a GDPR.The information generated by Facebook is usually transferred to and stored on a Facebook server, which may also involve transmission to the servers of Meta Platforms Inc. in the USA. You can revoke your consent at any time with effect for the future. To exercise your revocation, remove the checkmark set in the "Cookie Consent Tool" embedded on the website next to the setting for the "Facebook Pixel".

Pinterest-Retargeting-Pixel
A pixel (Pinterest tag) from Pinterest Europe Ltd. (Palmerston House, 2nd Floor, Fenian Street, Dublin 2, Ireland (“Pinterest”) is integrated on this website. The pixel allows information about the surfing behavior of website visitors to be collected, stored, and evaluated in pseudonymized form. If personal data is also processed in this context, this is done on the basis of our legitimate interest in displaying personalized advertising in accordance with Art. 6 para. 1 lit. f GDPR. The information can be attributed to the user's person with the help of further information that Pinterest has stored about the user, for example based on the ownership of an account on the social network “Pinterest”. Pinterest analyzes the surfing behavior using an algorithm and can then display targeted product recommendations as personalized advertising banners on the user's Pinterest account. In addition, Pinterest can link the information collected via the pixel with further information that Pinterest has collected about other websites and/or in connection with the use of the social network “Pinterest” and thus create pseudonymized user profiles. Pinterest Tag Conversion Tracking
This website uses the conversion tracking technology "Pinterest Tag" from Pinterest Europe Ltd., Palmerston House, 2nd Floor, Fenian Street, Dublin 2, Ireland ("Pinterest").
If you have reached our website from a pin on Pinterest, we will set a cookie on your computer that interacts with a "tag" implemented in the form of JavaScript code from Pinterest. Cookies are small text files that are stored on your device. These cookies expire after 180 days and are not used for personal identification.
If the user is redirected from a pin on Pinterest to pages of this website and the cookie has not yet expired, the tag captures certain user actions that we have predefined and can track them (e.g. completed transactions, leads, website search queries, product page views). When such an action is executed, your browser sends an HTTP request from the cookie via the Pinterest tag to the Pinterest server, transmitting certain information about the action (including the type of action, time, and browser type of the device).
This transmission allows Pinterest to create statistics on user behavior on our website after being redirected from a Pinterest pin, which we can use to optimize our offerings.
If personal user data is processed in this process, this is done in accordance with Art. 6 para. 1 lit. f GDPR based on our legitimate interest in statistically evaluating the success of product ads on Pinterest and the purchasing behavior of users, and serves to optimize our online offerings.
However, we do not receive any information that allows us to personally identify users.

TikTok Pixel
This website uses the “TikTok Pixel”, a tracking technology of the social network “TikTok” operated by TikTok Technology Limited, 10 Earlsfort Terrace, Dublin, D02 T380, Ireland (“TikTok”).
Using cookies (small text files that are stored on the user's device), information about the browsing behavior on our website is collected in pseudonymized form, transmitted to TikTok, stored there, and evaluated in order to enable the display of interest-based and personalized product recommendations on TikTok. The subject of the information collected and pseudonymously processed in this way is basically the device ID, the device type, timestamp, the operating system used, and the IP address. The information can be assigned to the user's person with the help of additional information that TikTok has stored about the user, for example, due to ownership of an account on the social network “TikTok”. TikTok can also combine the information collected via the pixel with additional information that TikTok has collected about other websites and/or in connection with the use of the social network “TikTok”, and thus create pseudonymized usage profiles. In no case can the information collected be used to personally identify visitors to this website.
The TikTok Pixel also enables us to track the effectiveness of advertisements on TikTok. If the user is redirected from an advertisement on TikTok to pages of this website and the cookies have not yet expired, the pixel records certain user actions that we have predefined and can track them (for example, completed transactions, leads, search queries on the website, and calls to product pages). When such an action is carried out, your browser sends an HTTP request from the cookie via the TikTok Pixel to the TikTok server, which transmits certain information about the action. Through this transmission, TikTok can create statistics about user behavior on our website after being referred from a TikTok advertisement, which serve us to optimize our offerings.
All of the above-described processing, in particular the setting of cookies to read information on the user's device, is only carried out if you have given us your express consent in accordance with Art. 6 (1) lit. a GDPR. Without this consent, the use of the TikTok Pixel will not take place during your visit to the site.
You can revoke your consent at any time with effect for the future. To exercise your revocation, please disable this service in the “cookie consent tool” provided on the website. We have concluded a contract with TikTok for the use of the TikTok Pixel, in which TikTok is obliged to protect the data of our website visitors and not to pass it on to third parties. TikTok generally transmits the collected information outside of the European Economic Area and relies on the so-called standard data protection clauses of the European Commission, which are intended to ensure compliance with the European level of data protection.

13) Tools and Miscellaneous

Cookie consent tool based on Usercentrics technology

This website uses a cookie consent tool with technology from Usercentrics GmbH, Sendlinger Straße 7, 80331 Munich (hereinafter referred to as "Usercentrics") to obtain effective user consent for cookies and cookie-based applications that require consent.

By including corresponding JavaScript code, users are shown a banner when they visit the site, in which they can grant consent for certain cookies and/or cookie-based applications by checking a box. The tool blocks the setting of all cookies that require consent until the user grants corresponding consent by checking the box. This ensures that such cookies are only set on the user's respective device if consent has been granted.

In order for the cookie consent tool to be able to uniquely assign page views to individual users, record and save the consent settings made by the user individually for a session duration, certain user information (including the IP address) is collected when our website is accessed via the cookie consent tool, transmitted to Usercentrics servers, and stored there.

These data processing operations are carried out in accordance with Art. 6 para. 1 lit. f GDPR based on our legitimate interest in a legally compliant, user-specific and user-friendly consent management for cookies and thus in a legally compliant design of our website.

Furthermore, the legal basis for the described data processing is Art. 6 para. 1 lit. c GDPR. As the controller, we are subject to the legal obligation to make the use of technically unnecessary cookies dependent on the respective user's consent.

We have concluded a contract for order processing with Usercentrics, with which we oblige Usercentrics to protect the data of visitors to our website and not to pass them on to third parties.

Further information on data use by Usercentrics can be found in the Usercentrics privacy policy at https://usercentrics.com/privacy-policy/.

If you make use of your right to object, we will cease processing the data concerned. However, further processing is reserved if we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing serves the assertion, exercise or defense of legal claims.

If we process your personal data to operate direct advertising, you have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising. You can exercise your right of objection as described above.

If you make use of your right to object, we will cease processing the data concerned for direct advertising purposes.

Duration of storage of personal data

The duration of storage of personal data is based on the respective legal basis, the purpose of processing, and - if applicable - additionally based on the respective statutory retention period (e.g. commercial and tax retention periods).

When processing personal data based on explicit consent pursuant to Art. 6 para. 1 lit. a GDPR, this data is stored until the data subject revokes their consent.

If there are statutory retention periods for data processed in the context of contractual or quasi-contractual obligations based on Art. 6 para. 1 lit. b GDPR, this data will be routinely deleted after the retention periods have expired, unless it is required for contract fulfillment or initiation and/or we have a legitimate interest in continuing to store it.

When processing personal data based on Art. 6 para. 1 lit. f GDPR, this data is stored until the data subject exercises their right to object under Art. 21 para. 1 GDPR, unless we can demonstrate compelling legitimate grounds for the processing that override the interests, rights, and freedoms of the data subject, or the processing serves to assert, exercise, or defend legal claims.

When processing personal data for the purpose of direct marketing based on Art. 6 para. 1 lit. f GDPR, this data is stored until the data subject exercises their right to object under Art. 21 para. 2 GDPR.

Unless otherwise stated in the specific processing situations provided in this statement, stored personal data will otherwise be deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
